39.-Your Petitioners therefore submit that the Award of Major Gener BLACK is void because it was an arbitrary act not based on any evidence appl cable to cases of compensation, because it is against the weight of evidence su mitted to the Government by your Petitioners, which evidence was never dispute and by reason of its being unjust to your Petitioners.

40.-Your Petitioners are willing to refer the matter to arbitration eithe in England or in Hongkong as to you may seem best. Your Petitioners therefong humbly pray

1.-That under the above circumstances and inasmuch a the method of compensation provided by the Pray Reclamation Ordinance, 1889, has proved a failur you will direct that the compensation to be paid to your Petitioners, if not agreed to between you Petitioners and the Government, be ascertained by Arbitration in the usual manner, either in England or Hongkong.

2.-That a local Ordinance may be passed to provide when Her Majesty's Lessees are disturbed in the enjoyment of their Crown Leases, legal means for ascertaining the amount of compensation to be paid for any such disturbance, similar to the means provided in England under the Lands Clauses Consolidation Acts.

3.--Such other relief as the nature of the case may require

1st February, 1899. the Reclamation is now being carried on in front of the Godowns, and gross rent for January, 1899, was only $471.74, from which the cost of earning has to be deducted.

The rent now offered for the whole of the Godowns is only $300 per month, owners paying rent and Insurance,
